Terms of Use

Please read these Terms of Use carefully before using the All Calls Done platform. These Terms form a legally binding agreement between you and All Calls Done.

1. Acceptance of Terms

  • By accessing or using All Calls Done (the "Service") you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree you may not use the Service.
  • We may update these Terms at any time. Material changes will be communicated via email or in-app notice at least 14 days before they take effect. Continued use after that date constitutes acceptance.

2. Description of Service

  • All Calls Done provides an AI-powered chat and voice widget that trade and service businesses embed on their websites to capture leads, answer customer questions, and book appointments.
  • The Service includes a hosted dashboard, an embeddable JavaScript widget, a voice agent powered by real-time WebRTC, Google Calendar integration, and a knowledge-base file store.

3. Eligibility and Account Registration

  • You must be at least 18 years old and capable of forming a binding contract to use the Service.
  • You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.
  • You must provide accurate and complete information when registering and keep it up to date.
  • One account may be associated with one AI agent. You may not create multiple accounts to circumvent plan limits.

4. Acceptable Use

  • You may use the Service only for lawful purposes and in accordance with these Terms.
  • You must not use the Service to transmit spam, malware, or any content that is unlawful, defamatory, harassing, or infringing of third-party rights.
  • You must not reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • You must not use the Service to compete directly with All Calls Done — including building a substantially similar product — without our prior written consent.
  • You must not attempt to circumvent any rate limits, security controls, or access restrictions.
  • The AI agent may not be configured to deceive end-users into believing they are speaking with a human employee. Where required by applicable law (e.g., CIPA in California) you must disclose that users are interacting with an automated system.

5. Your Content

  • You retain ownership of content you upload — including knowledge-base files, business configuration, and branding assets.
  • By uploading content you grant us a non-exclusive, worldwide, royalty-free licence to host, process, and display that content solely to operate the Service on your behalf.
  • You are solely responsible for ensuring you have the right to upload any content and that it does not violate third-party intellectual property rights.
  • We reserve the right to remove content that violates these Terms or applicable law.

6. Visitor Data and Lead Capture

  • You are the data controller for personal data your widget collects from your website visitors (names, email addresses, phone numbers submitted as leads).
  • You must have a compliant privacy notice on your own website disclosing that an AI widget may collect visitor information.
  • You must not use lead data collected through the Service in violation of applicable privacy laws, including GDPR, CCPA, or equivalent regulations in your jurisdiction.

7. Subscriptions and Billing

  • Access to paid features requires an active subscription managed through Polar.sh.
  • Subscriptions are billed monthly or annually in advance. All fees are non-refundable except as required by law or as stated in our refund policy.
  • We may change pricing with at least 30 days' notice. If you do not cancel before the next billing cycle you accept the new price.
  • Failure to pay may result in suspension or termination of your account.

8. Intellectual Property

  • All Calls Done, its logo, and the Service (excluding your content) are the intellectual property of All Calls Done and its licensors.
  • We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service during the term of your subscription.
  • Nothing in these Terms transfers any ownership of our intellectual property to you.

9. Third-Party Services

  • The Service integrates with third-party platforms including Google Calendar, LiveKit, Deepgram, Cartesia, Cerebras, and others. Your use of those services is governed by their own terms and privacy policies.
  • We are not responsible for the availability, accuracy, or conduct of third-party services.

10. Disclaimers

  • THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
  • We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated responses will be accurate or complete. You are responsible for reviewing and acting on any output the AI produces.

11. Limitation of Liability

  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL CALLS DONE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE.
  • OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

  • You agree to indemnify, defend, and hold harmless All Calls Done and its officers, directors, employees, and agents from any claims, liabilities, damages, and costs (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms.

13. Termination

  • You may cancel your account at any time from the dashboard or by contacting support.
  • We may suspend or terminate your account immediately if you breach these Terms, fail to pay fees, or if we are required to do so by law.
  • On termination, your right to use the Service ceases. We will delete your data in accordance with our Privacy Policy.

14. Governing Law and Disputes

  • These Terms are governed by the laws of the jurisdiction in which All Calls Done is registered, without regard to conflict-of-law principles.
  • Any dispute arising from these Terms will first be addressed through good-faith negotiation. If unresolved, disputes will be submitted to binding arbitration on an individual basis — not as a class action.
